1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Aura Technologies LLC, a limited liability company organized under the laws of the United States ("Aura Technologies," "Company," "we," "us," or "our"), concerning your access to and use of the Monk Mode mobile application, website located at https://monk-mode.lifestyle, and any related services, features, content, or applications offered by us (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE THE SERVICE.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. DESCRIPTION OF SERVICE

Monk Mode is a focus-enforcement and digital wellness application designed to help users reduce compulsive app usage, improve focus, and enhance productivity. The Service may include, but is not limited to:

• System-level application and website blocking features
• Unlock friction, open limits, and enforcement controls
• Usage analytics, trends, and recovery scoring tools
• Focus sessions, challenge alarms, and habit reinforcement systems
• Educational content and resources
• Community features (where applicable)

The Service is provided for personal, non-commercial use only, unless otherwise agreed to in a separate written agreement with Aura Technologies LLC.

3. USER ACCOUNTS AND REGISTRATION

3.1 Account Creation: To access certain features of the Service, you may be required to create an account. You must provide accurate, complete, and current information during the registration process and update such information to keep it accurate, complete, and current.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

3.3 Age Requirements: You must be at least 13 years of age to use the Service. If you are under 18 years of age, you may only use the Service with the involvement and consent of a parent or legal guardian.

5.2 Trademarks: "Monk Mode," "Aura Technologies," and all related names, logos, product and service names, designs, and slogans are trademarks of Aura Technologies LLC. You must not use such marks without our prior written permission.

5.3 User Content: By submitting, posting, or displaying content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with operating and providing the Service.

6. PRIVACY

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy, which also governs the Service and informs users of our data collection practices.

7. DISCLAIMERS

7.1 AS-IS BASIS: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

• The results obtained from the use of the Service will be accurate or reliable
• Any errors in the Service will be corrected

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AURA TECHNOLOGIES LLC, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service

IN NO EVENT SHALL AURA TECHNOLOGIES LLC'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Aura Technologies LLC and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. GOVERNING LAW AND DISPUTE RESOLUTION

10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

10.2 Arbitration: Any dispute arising out of or relating to these Terms or the Service shall be finally settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.

10.3 Class Action Waiver: YOU AGREE THAT ANY DISPUTES SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11. TERMINATION

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

12. GENERAL PROVISIONS

12.1 Entire Agreement: These Terms constitute the entire agreement between you and Aura Technologies LLC regarding the use of the Service.

12.2 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

12.3 Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

12.4 Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights under these Terms without your consent.

12.5 Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control.
